1. Acceptance of Terms
By downloading, installing, or using the Cee app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms are an agreement between you and See The Colour ("we," "us," or "our").
2. Description of the App
Cee is an iOS application that extracts dominant colours from photos and provides colour information in HEX, RGB, CMYK, and HSB formats. The App is available as a free tier with limited daily scans and a paid subscription ("Cee More") with additional features. All colour extraction is performed on your device.
Colour accuracy: Colour values produced by Cee are algorithmically derived and are approximate. Results may vary depending on lighting conditions, camera quality, and display calibration. Cee does not guarantee exact colour matches for professional colour-critical applications.
3. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, a parent or guardian must have reviewed and agreed to these Terms on your behalf.
4. Free Tier and Subscription
Free Tier
The free version of Cee provides up to 5 colour scans per rolling 24-hour period. This limit is enforced by a timer that begins at your first scan of each cycle.
Cee More
Cee More is a paid monthly subscription available at $4.99 USD/month (pricing may change with notice). Cee More unlocks unlimited scans, the Live Camera Picker, and additional swatch detail features.
Subscriptions are processed through Apple's in-app purchase system and subject to Apple's subscription terms:
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
Manage or cancel your subscription at any time through your Apple ID account settings
Refund requests are handled by Apple in accordance with their refund policy
Scan Limit Integrity
Attempting to circumvent the free scan limit by manipulating device time, reinstalling the app, or other means is a violation of these Terms.
5. Intellectual Property
The App and all content created by See The Colour — including the Cee name, logo, ColourSense™ branding, and UI design — is owned by See The Colour and protected by applicable intellectual property law.
You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal Apple device(s) for personal, non-commercial use in accordance with these Terms and Apple's App Store terms.
You may not:
Copy, modify, or distribute the App or any part of it
Reverse engineer or attempt to extract the App's source code
Use the Cee name, logo, or ColourSense™ branding without prior written permission from See The Colour
6. Your Content
Photos you import or capture using the App remain yours. You grant See The Colour no licence over your photos or saved palettes — all processing occurs locally on your device and your content is never transmitted to us.
You are responsible for ensuring you have the right to use any photos you import into the App.
7. Acceptable Use
You agree not to use the App to:
Violate any applicable law or regulation
Infringe the rights of any third party
Interfere with or disrupt the App's functionality
Circumvent the free tier scan limit through any technical means
8. Third-Party Services
The App interacts with Apple's systems for distribution, in-app purchase, and device features (camera, photo library, Live Activities). Your use of these features is also subject to Apple's terms and privacy policy. We are not responsible for Apple's services or policies.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, See The Colour disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that colour extraction results will meet professional colour accuracy standards.
10. Limitation of Liability
To the fullest extent permitted by law, See The Colour shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for Cee More subscriptions in the 12 months preceding the claim, or $10 CAD, whichever is greater.
11. Governing Law
These Terms are governed by the laws of Canada. Any disputes shall be subject to the jurisdiction of the courts of Canada.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
13. Termination
We reserve the right to suspend or terminate your access to the App if you violate these Terms. Upon termination, your licence to use the App ends. Locally stored data on your device remains accessible to you.
